Michienzi Drafting & Design copyrights each of its DESIGNS & SKETCHES in an effort to better control the quality of our work. Please read through this copyright section to ensure that you do not perform activities with our designs that are in violation of copyright laws.
All home plans & photos present on this site are protected by copyright. Reproduction of these either in whole or in part, including any form and/or preparation of derivative works thereof, for any reason without prior written permission is strictly prohibited.
Plans MAY NOT be used to build more than one house. When you purchase construction documents, we, as licensor, are granting to you, as licensee, the right to use the documents to construct a single unit. This is an exclusive license, which may not be resold, duplicated, published or distributed without written permission of the designer, architect or publisher.
Reproducing Blueprints: Construction blueprints may not be reproduced without prior written consent of the designer or publisher. If additional sets are required for estimating or construction, please contact us for additional sets at a nominal cost. Copy shops and blueprinters are prohibited from making copies of these copyrighted documents.
Making Design Modifications: As a plan licensee, you may customize the design to fit your personal preferences, but you must understand that the modification of the plan is performed at your own risk and should be reviewed by a professional architect, home designer or engineer prior to the start of construction. Modified plans are considered "derivative works" of the original, and it is critical that you understand that these "derivative works," as well as the original work, still retain copyright protection. Any "derivative work" or revised design, even if completely redrawn, may not be sold, duplicated, distributed or used to construct any units without the purchase of a license from the publisher, architect or designer.
Who is responsible for COPYRIGHT INFRINGEMENT? All parties, including the purchasers, designers, drafters, home owners, builders, contractors, subcontractors, copy shops and blueprinters may be responsible if a copyright is violated. It does not matter whether an individual knows that a violation is being committed. To avoid legal complications and damages, it is critical that you be certain of the original plan source, and refuse to be a party to any illicit copying or borrowing of designs, derivative works, prints and design features.
PLEASE RESPECT MICHIENZI DRAFTING & DESIGN COPYRIGHTS: In the event of any suspected violation of a copyright, or if there is any uncertainty about the plans purchased, the publisher, architect or designer should be contacted before proceeding.
PENALTIES FOR INFRINGEMENT: Penalties for violating a copyright may be very severe. The responsible parties are required to pay the designer or architect's actual damages (which may be substantial), plus any profits made. The copyright law also allows the designer or architect to recover statutory damages, which may be as high as $100,000. Finally, the infringer may be required to pay the architect or designer's reasonable legal fees, which often exceed the damages.

HOW IT WORKS...
PLANNING AND GOALS FOR:
NEW CONSTRUCTION: Your first scheduled appointment at the office of Michienzi Drafting & Design is to discuss your ideas for your new project. Any information, such as plot plans, set back requirements, pictures and ideas will be helpful to begin the designs. The information is then used to prepare a SKETCH DESIGN for your review. This sketch would normally include floor plans and a front view of your construction project.
ADDITIONS/REMODELS: Your first scheduled appointment to the existing building is to discuss your ideas and compile measurements and pictures of current conditions. Any information, such as plot plans, set back requirements, pictures and ideas will be helpful to begin the designs of your new addition or remodeling project. The information is then brought to the office of Michienzi Drafting & Design where a SKETCH DESIGN would be created for your review. This sketch would normally include floor plans and a pictorial view of the outside of your project.
SKETCH DEVELOPMENT FOR NEW CONSTRUCTION & ADDITIONS/REMODELS: The Sketch Development Phase involves funneling all of the PLANNING & GOALS in to a well thought out sketch for the DESIGN DEVELOPMENT.
DESIGN DEVELOPMENT FOR NEW CONSTRUCTION & ADDITIONS/REMODELS: The Design Development Phase involves revisions and discussion of the SKETCH DESIGN to advance the project to CONSTRUCTION DOCUMENTS.
CONSTRUCTION DOCUMENTS: The complete package of CONSTRUCTION DOCUMENTS will consist of all needed elevations, a foundation, a floor plan, door and window schedules, an Energy Compliance Certificate, and construction details.
Brenda Michienzi of Michienzi Drafting & Design has 27 + years of experience in residential design and holds an Unrestricted Massachusetts Construction Supervisor License, but is not a registered architect. In most situations a registered architect is not needed. However, should one be required or requested Michienzi Drafting & Design works hand in hand with a structural engineer licensed in both Mass. and NH.
The fee for each project is charged at an hourly rate. An estimate of design time will be given during the PLANNING & GOALS phase once the project has been seen and ideas discussed. There is an additional charge for copies of the CONSTRUCTION DOCUMENTS which varies for each design and circumstances. Fees do not include a structural review of the drawing should one be needed.
